Warnings and Disciplinary Action

Purpose

The purpose of this policy is to provide a fair, consistent, and transparent framework for addressing Maryland Global Initiatives Corporation (MGIC) employee performance concerns and misconduct. The policy outlines the actions to be taken in a fair, respectful, and timely manner.

Background

MGIC personnel are employed through Employer of Record (EOR) service providers in countries outside the United States, on behalf of Requesting Units of the University of Maryland, Baltimore (UMB) and constituent universities that engage MGIC services through an agreement with UMB. (For purposes of MGIC policies only, these constituent universities are referred to as “Affiliate Entities”). Requesting Units directly supervise and manage the MGIC employees assigned to them, following MGIC policies and procedures.

MGIC expects all employees to operate and behave in a professional manner at all times.   MGIC expects the Requesting Unit to use a structured disciplinary process to correct behavior, safeguard the workplace, and support employee success.

The International Operations (IO) division of UMB’s Administration and Finance department administers the MGIC mechanism and its human resources (HR) functions.

Policy Statement

  1. MGIC expects employees to conduct themselves professionally and to comply with all policies and applicable laws while performing their duties. (See MGIC policy on Ethics and Conduct, MGIC policy on Standards of Conduct for MGIC Personnel, and MGIC policy on Financial Conduct and Responsibility).
  2. Requesting Unit supervisors must hold MGIC employees assigned to the Unit accountable for their professional conduct.
  3. When performance expectations are not met, whether due to deficiencies or conduct, supervisors are expected to apply a progressive discipline approach to correct issues at the lowest effective level.
  4. Warnings and disciplinary action will be taken when the employee’s performance is consistently and persistently below expectations, or if an employee violates the general standards of conduct, engages in improper, unethical, or illegal behavior, or otherwise engages in misconduct or gross misconduct. Warnings and disciplinary action must be clearly and respectfully communicated as well as documented.
  5. All disciplinary action vis-a-vis MGIC employees must comply with local labor laws. The MGIC President and/or IO division may engage local legal counsel to undertake disciplinary procedures mandated by law. Requesting Units are required to participate fully in any local legal proceedings and to cover the cost of legal counsel.
  6. MGIC employees and Requesting Units are required to abide by warnings and disciplinary actions, and the outcomes of personnel decisions rendered by MGIC.

Scope

This policy applies to all MGIC personnel and the Requesting Units to which MGIC employees are assigned.

Responsibilities:

  1. MGIC employees: Comply with all aspects of this policy.
  2. IO division staff: Facilitate local legal counsel and EOR engagement as needed to undertake disciplinary action in compliance with applicable labor law.
  3. Requesting Units: Comply with all aspects of this policy.
