Leave

Purpose

This policy clarifies leave entitlements for employees of Maryland Global Initiatives Corporation (MGIC). The policy seeks to emphasize the importance of leave utilization by employees for both legal compliance and personal well-being. It also aims to promote compliance with local labor laws in the management of employee leave.

Background

MGIC employees are employed through Employer of Record (EOR) service providers in countries outside the United States, on behalf of Requesting Units of the University of Maryland, Baltimore (UMB) and constituent universities that engage MGIC services through an agreement with UMB. (For purposes of MGIC policies only, these constituent universities are referred to as “Affiliate Entities”). Requesting Units directly supervise and manage the MGIC employees assigned to them, following MGIC policies and procedures.

MGIC employees live and work in multiple countries with varied statutory requirements pertaining to employee leave entitlements.  Each employee accesses leave in line with the leave benefit terms defined in their employment agreement and the MGIC Global HR Handbook.

The International Operations (IO) division of the UMB Administration and Finance department administers the MGIC mechanism and manages the human resources (HR) function.

Policy Statement

  1. MGIC is committed to supporting employees’ health and well-being, which includes providing options for reasonable leave. MGIC follows the mandatory leave entitlement of the country of employment.
  2. MGIC employees are expected to take their leave entitlement annually. MGIC employees are responsible for tracking their used leave in partnership with their supervisors and are encouraged to utilize MGIC’s online leave management platform to avoid errors.
  3. Supervisors in Requesting Units must ensure that MGIC employees are approved to take their entitled leave throughout the year and are expected to manage team workloads and coverage accordingly.
  4. MGIC allows employees to carry over up to ten (10) days of accrued leave to the following year. Leave accrual beyond this set annual carry-over limit is prohibited unless a policy exemption has been requested by the Requesting Unit and approved by the MGIC Vice President – Policy & Administration.
  5. The Global HR Handbook and Country Schedule detail the types of leave and the requirements for employee usage in each country. In accordance with local labor law, leave may include annual, sick, unpaid, compassionate, parental (including maternity, paternity, and adoption), and study leave.
  6. MGIC staff also observe public holidays that are declared by the national government of their country of employment. The Global HR Handbook and Country Schedule define the observed national holidays for local employees. Supervisors in Requesting Units must honor the public holidays of the country of employment.

Scope

This policy applies to all MGIC employees and their supervisors in Requesting Units.

Responsibilities 

  1. MGIC Employees: Comply fully with all aspects of this and related referenced policies. 
  2. IO International HR Manager: Maintain current and accurate MGIC Global HR Handbook and Country Schedule to support compliance with labor laws and MGIC policies. Administer MGIC leave management tools and procedures, and ensure MGIC employees and Requesting Unit supervisors understand the policy compliance requirements.  
  3. Assistant Vice President - IO (in the capacity of MGIC VP – Policy & Administration): Oversee MGIC policy administration. Approve or deny requests for policy exceptions.  
  4. Requesting Units: Comply fully with all aspects of this and related policies.
