Performance Management
Purpose
The purpose of this policy is to establish performance management requirements for Maryland Global Initiatives Corporation (MGIC) employees. The policy ensures that all MGIC employees receive regular feedback, clear performance expectations, and formal performance evaluations aligned with Requesting Unit business objectives.
Background
MGIC engages employees through an Employer of Record (EOR) on behalf of Requesting Units in the University of Maryland, Baltimore (UMB) and constituent universities using MGIC through agreement with UMB (for purposes of MGIC policies only, these universities are referred to as “Affiliate Entities”). Requesting Units are responsible for managing and supporting the performance of their employees engaged through MGIC.
The International Operations (IO) division of UMB’s Administration and Finance department administers the MGIC mechanism and manages its human resources (HR) function.
Policy Statement
- Performance of MGIC employees is managed through their respective Requesting Units. Performance goals and objectives are agreed between the MGIC employee and their supervisor, and performance is monitored, supported, and documented through structured reviews and continuous constructive feedback throughout the performance cycle in compliance with the organizational procedures of the Requesting Unit.
- Any outcomes from a performance management process, including performance improvement plans or merit-based changes to position or compensation, must comply with local labor laws. MGIC may engage local legal counsel as needed to address employee grievances or facilitate employer actions in compliance with labor law, with costs charged to the Requesting Unit. - The IO division will facilitate employment actions resulting from performance management processes with the EOR as necessary, and may escalate situations of negligent performance management to the leadership of Requesting Units or the MGIC Board as needed.
Scope
This policy applies to all MGIC employees and Requesting Units.
Responsibilities
- MGIC Employees: Comply fully with all aspects of this and related referenced policies.
- IO International HR Manager: Coordinate employment actions resulting from performance management processes with EOR and Requesting Unit to ensure compliance with local labor laws. Engage local legal counsel when necessary on behalf of MGIC and the Requesting Unit. Advise Requesting Units on performance management processes in contexts outside the United States.
- Requesting Units: Comply fully with all aspects of this and related/referenced policies.
