The 1807 Art & Literary Journal (1807) is a copyright of the University of Maryland, Baltimore (UMB). All artists/authors who submit entries to the 1807 Art & Literary Journal shall retain the copyright to their specific piece or article of work. 1807 content may not be reproduced in whole or part without the express written consent of the copyright owner, UMB, except for limited personal use as permitted by law.
Upon submission of an entry, the artist or author must certify the following:
- The artist or author warrants that to the best of their knowledge, they are the sole (or joint) creator of the art or literary work and they have the power to convey all rights which may be related to the work.
- The art or literary work submitted does not infringe any copyright or property right of another person.
- If the art or literary work submitted reproduces any textual or graphic material that is the property of another for which permission is required, the artist or author shall obtain written consent to such reproduction prior to publication in 1807.
- The art or literary work submitted has not previously been published, in whole or in part, except as indicated in the submission form.
- The art or literary work submitted will be accepted for review if it does not contain matter that is defamatory, pornographic, violates another person's civil rights, right of privacy, right of publicity, or other legal right, and is not otherwise unlawful.
- If the artist or author submits the artwork or writing to any other journal, magazine, contest, competition, etc., the artist must inform the UMB Council for the Arts & Culture immediately if it is accepted for publication.
As part of the submission process, the artist will sign a release granting UMB the right to publish, reproduce, and use submitted artwork or literary works, in whole or in part, in the following ways:
- printed and digital editions of 1807
- curated UMB art galleries and exhibitions featuring work from 1807
- promotional and marketing materials, including but not limited to advertisements, communications, notecards, posters, prints, social media, and other tangible or digital items related to 1807
- archived copies of 1807 in the UMB Digital Archive supported by the Health Sciences and Human Services Library
- 1807 merchandise or other items produced for distribution or sale; any income generated will be used to support or offset the costs of production and promotion of 1807
While every attempt will be made to honor the integrity of the artistic design, layout, spacing etc. of an image or written item, the artist or author grants UMB permission to make necessary edits to format it to meet UMB’s website or other platform needs, parameters, or restrictions, including the 1807 journal.
UMB reserves the right to adapt and adjust the selection criteria based on the number of submissions received for any given issue.
If a claim is asserted against UMB or 1807 or the Council for the Arts & Culture as a result of an alleged breach of these representations by the artist or author, and a settlement of such claim requires UMB or 1807 or the Council for the Arts & Culture to make a money payment, or if a money judgment is rendered, UMB is entitled to seek reimbursement from the artist or author for the amount of such payment or judgment, as well as costs and expenses reasonably incurred in defending against the claim.
