H VISAS - TEMPORARY WORKER’S VISA
What is an H-1B?
H-1B status permits a U.S. employer to employ a non-U.S. citizen in a specialty occupation. Specialty occupation is defined as requiring the theoretical and practical application of a body of highly specialized knowledge in a field of study.
In order to qualify for H-1B sponsorship, a position must require at least a Bachelor's degree in specific field(s) of study. H-1B petitions are filed by the employer; as such, an individual in the U.S. in H-1B status is only authorized to work for his/her sponsoring employer.
There are labor and immigration laws which govern H-1B sponsorship. Below is a summary of issues university departments should be aware of when deciding whether to sponsor an H-1B for an employee.
